MISDEMEANOR POT POSSESSION

THE LAW & THE PUNISHMENT

  • Less than 100 grams of marijuana = minor misdemeanor; maximum fine of $150, plus court costs (license suspension discretionary);

  • Between 100-200 grams of marijuana = fourth degree misdemeanor; maximum jail sentence of 30 days and up to $250 fine, plus court costs (license suspension discretionary);

  • Between 200-1000 grams of marijuana = fifth degree felony; maximum jail sentence of 12 months and up to $2,500 fine, plus court costs (license suspension discretionary);

  • Between 1000-5000 grams of marijuana = third degree felony; maximum jail sentence of 5 years and up to $10,000 fine, plus court costs (license suspension discretionary); and

  • for higher amounts, you need to call a lawyer immediately(!)

TIPS TO AVOID CONVICTION

  • If you have pot in your vehicle, do not commit any traffic offenses that would give rise to a stop and potential search;

  • If you have pot on your person, do not act disorderly in public or display it in crowded areas; and

  • Call your lawyer! Most college students are charged with either a minor misdemeanor or fourth degree misdemeanor. Anything above that, and you are risking the accusation of trafficking.
